Subd 8access By Juvenile Justice System
Upon request, the following education data shall be disclosed under subdivision 3, clause , to the juvenile justice system: a student’s full name, home address, telephone number, date of birth a student’s school schedule, daily attendance record, and photographs, if any and parents’ names, home addresses, and telephone numbers.
In addition, the existence of the following data about a student may be disclosed under subdivision 3, clause :
use of a controlled substance, alcohol, or tobacco
assaultive or threatening conduct that could result in dismissal from school under section 121A.45, subdivision 2, clause or
possession or use of weapons or look-alike weapons
theft or
vandalism or other damage to property.
Any request for access to data under this paragraph must contain an explanation of why access to the data is necessary to serve the student.
Nothing in this subdivision shall limit the disclosure of educational data pursuant to court order.
A school district, its agents, and employees who provide data in good faith under this subdivision are not liable for compensatory or exemplary damages or an award of attorney fees in an action under section 13.08, or other law, or for a penalty under section 13.09.
A member of the juvenile justice system who falsely certifies a request for data under this section is subject to the penalties under section 13.09.

Subd 4baccess To Real Property Data Title Examination
Upon request, the secretary of state may share data regarding a program participant’s real property records for the purpose of confirming or denying that the program participant’s real property is the property subject to a bona fide title examination. The request must include:
the name, title, address, and affiliated organization, if applicable, of the person requesting data
the purpose for requesting data
the requestor’s relationship, if any, to the program participant subject to the data and
the legal description of the property subject to the title examination and any other information required by the secretary of state to respond to the request.
The secretary of state shall approve or deny a request for access to data within two business days.
In responding to a bona fide request, the secretary of state may respond by an affirmation in writing that the property subject to the title examination is or is not the property subject to a program participant’s real property notice. Notwithstanding subdivision 4a, or any law to the contrary, a party examining title may rely conclusively on the information contained in a written affirmation from the secretary of state.
Location data disclosed under this subdivision may be used only for the purposes authorized in this subdivision and may not be further disclosed to any other person. A person receiving private data under this subdivision shall establish procedures to protect the data from further disclosure.
Subd 6local Economic Development Data
Preliminary information. Access to preliminary information submitted to the commissioner of employment and economic development under sections 469.142 to 469.151 or sections 469.152 to 469.165 is limited under section 469.154, subdivision 2.
Enterprise zones. Data sharing between the commissioner of revenue and the commissioner of employment and economic development or a municipality receiving an enterprise zone designation is governed by section 469.173, subdivision 5.
Tax incentives. Disclosure of data by the Department of Revenue to determine eligibility for tax incentives available under section 272.0212, 469.1732, or 469.1734, is governed by section 469.1733, subdivision 1.
Program data collected on individuals are classified by section 116J.401, subdivision 3.
Disclosure of unemployment insurance hearing data is governed by section 268.105, subdivision 5.

Will Treating Someone For Stds Prevent Them From Getting Hiv
No. Its not enough. Screening for STDs can help assess a persons risk for getting HIV. Treatment of STDs is important to prevent the complications of those infections, and to prevent transmission to partners, but it should not be expected to prevent spread of HIV.
If someone is HIV-positive and is diagnosed with an STD, they should receive counseling about risk reduction and how to protect their sex partner from getting re-infected with the same STD or getting HIV.
Screening For Sti In Hiv Infection
Some people living with HIV remain active sexually and hence are vulnerable to STI if safer sex practice is not consistently adopted. Recommendations on STI screening are developed in the US and UK with the objective of improving sexual health for people living with HIV. Such strategy carries also public health implication in the early detection of STI followed by not just treatment but appropriate behavioural interventions. In the process of implementing these recommendations, the service providers may need to strengthen their capacity in areas such as sexual health risk assessment and counselling, clinical and laboratory management of concerning STI, partner management, and sexual health referral network.
Screening strategies vary from one setting to another. Box 39.4 shows a protocol for use in HIV specialist clinic or primary care services.
Further tests for other STI or collection of clinical samples from sites other than those specified in Box 39.3 are indicated by results of clinical assessment. More frequent STI screening may be appropriate depending on individual risk behaviour, local STI epidemiology especially in an outbreak situation. The protocol is not meant to replace routine clinical management of people with symptomatology or clinical features suggestive of STI.

Subd 6practitioners Of Mortuary Science
Mortuary science. Data submitted to the commissioner of health for a license, reciprocal license, or renewal of a license to practice mortuary science are classified under sections 149A.20, subdivision 13, 149A.30, subdivision 7, and 149A.40, subdivision 10.
Operation of funeral establishment. Data submitted to the commissioner of health for a license or renewal of a license to operate a funeral establishment are classified under sections 149A.50, subdivision 9, and 149A.51, subdivision 9.
Operation of a crematory. Data submitted to the commissioner of health for a license or renewal of a license to operate a crematory are classified under sections 149A.52, subdivision 8, and 149A.53, subdivision 8.
Subdivision 1application To Commissioner
Notwithstanding the provisions of section 13.03, the responsible authority of a government entity may apply to the commissioner for permission to classify data or types of data on individuals as private or confidential, or data not on individuals as nonpublic or protected nonpublic, for its own use and for the use of other similar government entities on a temporary basis until a proposed statute can be acted upon by the legislature. The application for temporary classification is public.
Upon receipt by the commissioner of an application for temporary classification, the data which is the subject of the application shall be deemed to be classified as set forth in the application for a period of 45 days, or until the application is disapproved, rejected, or granted by the commissioner, whichever is earlier.
If the commissioner determines that an application has been submitted for purposes not consistent with this section, the commissioner may immediately reject the application, give notice of that rejection to the applicant, and return the application. When the applicant receives the notice of rejection from the commissioner, the data which was the subject of the application shall have the classification it had before the application was submitted to the commissioner.

Subd 4motor Carrier Accident Data
All data submitted to the Department of Transportation in the form of motor vehicle carrier accident reports, except the portions of the report forms in which the carrier and the driver provide their version of the accident, are classified as nonpublic data with regard to data not on individuals, and private data with regard to data on individuals.
Protecting Your Sexual Partners
If you have HIV, are taking HIV medicine exactly as prescribed, and get and keep an undetectable viral load, you will not transmit HIV to an HIV-negative partner. However, while having an undetectable viral load will prevent you from passing HIV, it will not prevent you from transmitting other STIs to your sexual partners. Using condoms the right way every time can prevent the transmission of other STIs like gonorrhea and chlamydia. Routine testing for STIs is also important .
If you have a detectable viral load and another STI, you are at risk for transmitting both HIV and other STIs to your partners. But you can protect your partners from HIV and other STIs by using condoms and choosing less risky sexual behaviors.
And if you have an HIV-negative partner who has another STI, they may have skin ulcers, sores, or inflammation that may increase their risk of getting HIV during sex.
An HIV-negative partner can take medicine to prevent HIV, called pre-exposure prophylaxis, or PrEP, but PrEP does not protect against other STIs. PrEP is an HIV prevention option for people who dont have HIV but who are at risk of acquiring HIV. PrEP involves taking HIV medicines exactly as prescribed to reduce the risk of HIV infection. Both oral HIV medicines and a long-acting injectable form of PrEP are available.

Subd 10aaccess To Student Records School Conferences
A parent or guardian of a student may designate an individual, defined under paragraph , to participate in a school conference involving the child of the parent or guardian. The parent or guardian must provide the school with prior written consent allowing the significant individual to participate in the conference and to receive any data on the child of the consenting parent or guardian that are necessary and relevant to the conference discussions. The consenting parent or guardian may withdraw consent, in writing, at any time.
A school may accept the following form, or another consent to release student data form, as sufficient to meet the requirements of this subdivision:
“CONSENT TO PARTICIPATE IN CONFERENCES AND RECEIVE STUDENT DATA
I, ……………………………………. , as parent or guardian of ……………………………………. , consent to allow ……………………………………. to participate in school conferences and receive student data relating to the above-named child, consistent with Minnesota Statutes, section 13.32, subdivision 10a. I understand that I may withdraw my consent, upon written request, at any time.
Certain school accountability data are governed by sections 120B.35, subdivision 3, and 120B.36, subdivisions 1, paragraph , and 2.
Subd 12child Care Resource And Referral Programs
This subdivision applies to data collected by child care resource and referral programs under section 119B.19. Data collected under section 119B.19 are not licensing data under subdivision 4. Data on unlicensed family child care providers are data on individuals governed by subdivision 2. In addition to the disclosures authorized by this section, the names and addresses of unlicensed family child care providers may be disclosed to the commissioner of education for purposes of promoting and evaluating school readiness.
Tribal licensing agency access to criminal history data is governed by section 245C.12.

Make sure you have an open and honest conversation about your sexual history and STI testing with your health care provider and ask whether you should be tested for STIs.

Your health care provider is used to discussing sexual health. Besides, CDC estimates that there are more than 20 million new STI infections every year. So you are not alone and arent the only person talking to your health care provider about an STI.
Encourage your partner to get tested too. You or your partner might have an STI without having symptoms. You and your partner should determine what sexual behaviors and prevention practices are going to be used in your relationshipand outside of it if you are not exclusive. The goal of this communication is to keep you BOTH healthy and free from new infections. Here are some great tips on talking with your partner.
If you test positive, know that getting an STI is not the end! Many STIs are curable and all are treatable. If either you or your partner is infected with an STI that can be cured, both of you need to start treatment immediately to avoid getting re-infected.

Management Of Sex Partners
Treatment of sex partners of chlamydia-infected patients is important, both to prevent reinfection of the patient and to prevent further transmission to other susceptible individuals. Traditionally, chlamydia-infected patients have been instructed by providers to notify their partners that they have been exposed to chlamydia and should themselves be seen by a provider for testing and treatment. However, high rates of chlamydia reinfection suggest such partner notification practices often do not lead to treatment of the sex partner.

Subd 10home Care And Hospice Provider
Data regarding a home care provider under sections 144A.43 to 144A.47 are governed by section 144A.45. Data regarding home care provider background studies are governed by section 144A.476, subdivision 1. Data regarding a hospice provider under sections 144A.75 to 144A.755 are governed by sections 144A.752 and 144A.754.
Subd 2notification Of Certification
A program participant may submit a notice, in writing, to the responsible authority of any government entity other than the county recorder that the participant is certified in the Safe at Home address confidentiality program pursuant to chapter 5B. The notice must include the program participant’s name, names of other program participants in the household, address designated under chapter 5B, program participant signature, date the program participant’s certification in the program expires, and any other information specified by the secretary of state. A program participant may submit a subsequent notice of certification, if the participant’s certification is renewed. The contents of the notification of certification are private data on individuals.
To affect real property records, including but not limited to documents maintained in a public recording system, data on assessments and taxation, and other data on real property, a program participant must submit a real property notice in writing to the county recorder in the county where the property identified in the real property notice is located. A real property notice must be on a form prescribed by the secretary of state and must include:
the full legal name of the program participant, including middle name
the last four digits of the program participant’s Social Security number
the designated address of the program participant as assigned by the secretary of state, including lot number
